Terms of UseUsing The East Living — including browsing, requesting a quote, signing in, or listing as a supplier — means you accept this agreement with us. These terms are written for travelers and partners worldwide, including the United States, the United Kingdom, the European Union, and Africa. They work with our Privacy Policy, Marketplace disclaimer, and Supplier terms.
Who we are
The East Living (“we”, “us”) operates theeastliving.com. We are a marketplace. We help travelers discover verified local operators and guides, compare listed experiences, and request quotes. We do not operate tours, own vehicles, employ guides, or hold travel inventory. Any trip you book is a contract between you and the supplier — not with us.
Changes
We may update these terms. The version and date at the top of this page are the current agreement. Keep using the site after a change and you accept the new terms. If a change is material, we will say so on this page.
Listings and other content
Experience pages, prices, photos, itineraries, and operator profiles are provided by suppliers or by us from information they give us. They are invitations to inquire — not a confirmed booking. We work to keep listings accurate, but dates, park fees, and availability change. Confirm everything with the supplier before you pay them.
Reviews, comments, and other material from travelers are those people's views, not ours. We may edit or remove content that is unlawful, misleading, or abusive. We do not have to pre-screen every post.
Quote requests
Requesting a quote is free and creates no obligation to book, wherever you live. You do not need an account. You must use an email you can access: we send a short verification code so we know the address is real.
A verified request lands with our team first. We then match it to a verified operator, usually in Kenya, Tanzania, or another African country where the trip runs. Matching is how we stay curated. In Phase 1 it is not a fee, not an auction, and not a reason to inflate the listed price. By submitting a quote you ask us to send your details to that operator so they can email you. Payment, cancellation, visas, and the trip itself stay between you and that operator.
International travelers
Listed prices are typically shown in US dollars as a guide. The operator's quote is the price that matters — including park fees, seasonal rates, and the currency they invoice in. We are not a UK ATOL holder, not a US seller of travel, and not a licensed travel agent. We do not take trip payments in Phase 1, so your booking is not covered by ATOL, IATA, or similar protection schemes through us.
You are responsible for passports, visas, vaccinations, travel insurance, and entry rules for every country on the itinerary. Confirm those with the operator and the relevant government before you travel.
What you may post
If you send us a review, message, photo, or other material, you keep ownership of it. You also give The East Living a worldwide, royalty-free licence to display, store, and adapt that material so we can run and promote the marketplace (including search indexing). Do not post other people's personal data, spam, ads, or anything illegal or abusive. We may close an account or remove content when we need to.
Our brand and the site
The East Living's name, layout, and original copy on this site belong to us or our licensors. You may not copy the catalogue or reuse our brand without written permission. Supplier logos and itineraries remain theirs.
Operators and other third parties
When you deal with an operator, guide, or advertiser found here — including paying for a safari — that dealing is yours and theirs. We are not a party to that contract and we are not responsible for how they run the trip, handle your money, or keep you safe.
Operators may subscribe to a monthly plan for featured placement. That subscription is how we make money — it is not a pay-per-quote bid, not a commission on your trip, and not a ranking sold as “best tour.” See supplier packages.
Age
This site is for adults. You must be 18 or older to create an account, request a quote, or list as a supplier. If we learn someone under 18 has done so, we will delete that account and related content.
Accounts
If you create an account, keep your login private. You are responsible for activity under it. We may suspend the site or an account, in whole or in part, if we have to — including for maintenance, misuse, or a change of ownership.
No warranties
The site is provided as it is. We do not promise uninterrupted access, error-free pages, or that a listed trip will meet your expectations. Listed prices are “from” figures set by suppliers.
Liability
You decide whether to rely on any listing, quote, or review. To the fullest extent the law of your country allows, we are not liable for the conduct of users or suppliers, or for indirect loss — including lost bookings, lost data, or substitute travel — arising from use of the site. Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by our negligence.
If you are a consumer in the United Kingdom or the European Union, your statutory rights (including under the UK Consumer Rights Act 2015 where it applies) are not affected. If you are in the United States, some states do not allow limits on implied warranties or certain damages; those limits do not apply to you to the extent they are prohibited.
Your indemnity
You will cover The East Living and our team against claims and reasonable costs that arise from your breach of these terms or from content you submit.
If the business is sold
If we transfer this website or the company that runs it, this agreement and the personal data needed to keep the service running may transfer to the new operator. We will still treat that data as described in the Privacy Policy.
Law and disputes
These terms are in English. If a court strikes out one clause, the rest still apply. Kenyan law governs this agreement, except where the mandatory consumer, privacy, or other laws of your country of residence cannot be waived — those laws still protect you.
Please email us first and give us a chance to fix the issue. If we cannot resolve it: consumers in the UK or EU may bring a claim in the courts of their home country; consumers in the United States may bring a claim in a court of competent jurisdiction in their state, where that right cannot be waived; otherwise disputes may be brought in the courts of Kenya.
